PROCEDURE FOR ISSUANCE OF INTERMENT OR MOUNMENT CERTIFICATE IN THE ABSENCE OF PROOF OF INTERMENT RIGHTS CERTIFICATE OR RIGHTS HOLDER
ISSUE: In the past certificate of interment rights were either not issued or were lost. This then makes it difficult to ascertain who holds the interment rights on a particular plot or plots in our cemeteries.
LEGAL SITUATION: Only the rights holder(s) can determine or authorize either the interment of a casket and or urns or placement of monuments on the cemetery plot.
PROCEDCRE: In addition to application for either interment or placement of a monument, applicable fees, the applicant shall also provide an affidavit that covers the
following:
a) The applicant is the legal interment rights holder.
b) The list of other heir(s) to the original rights holder(s).
c) The fact that all other heirs(s) agree to the interment or
placement.
APPROVAL: When all procedures have been complied with and subject to the applicable rules and conditions of the cemetery permission to inter or placement of the approved monument will be given.
REFUSAL: Permission to inter or place a monument will not be granted unless the rights holder(s) can be determined.
TRANSFER OF RIGHTS: Interment rights are granted only to the person(s) listed on the certificate of interment rights issued by the cemetery. Those rights can be transferred to another person but only by way of an approved transfer form.
